Data protection declaration by Prior Art Publishing GmbH


Prior Art Publishing GmbH (hereafter: PAP) is a publishing house in the field of what is known as "strategic publication", and is domiciled at Manfred-von-Richthofen-Straße 9, 12101 Berlin.

By way of these data protection provisions PAP would like to inform you about how PAP processes your personal data. These data protection provisions supplement the General Terms and Conditions.

1. PAP's fundamental principles when processing your personal data

PAP obtains, processes and uses your personal data in compliance with the laws on data protection of the Federal Republic of Germany and the European Union provisions relating to data protection. PAP uses your personal data to allow you to take advantage of PAP's Internet services, for which registration is compulsory. "Personal data" means all individual details about your personal or material circumstances. The personal data which you must enter when registering for the PAP services (mandatory fields) is referred to as "registration details".

2. Registration details

In order for the PAP services to be able to function, when you register PAP needs to take certain personal data from you as your registration data, and to process this.

The registration details are - depending on the PAP services used - the following data:

-           Surname, forename

-           Address

-           Email address

-           Telephone number

-           Bank account information

-           User name

-           Password

PAP will never pass this data on to third parties or otherwise make third parties aware of it unless this is absolutely necessary for the performance of the services by PAP, or PAP is legally obliged to do so. The data that has been passed on in this way may be used by the recipient only for the purpose of carrying out its assignment. Any other use of the information is not permitted.

3. User data

PAP also stores the following data:

-       Company name

-       Fax number

-       Central email address

-       Delivery or billing address, if different

-       Order information

4. Use and passing on of the registration and user data

PAP stores the registration and user data primarily with a view to the best possible processing of orders and may, for this purpose, pass it on to other companies. The data that has been passed on in this way may be used by the recipient only for the purpose of carrying out its assignment. Any other use of the information is not permitted.

PAP also uses the registration and user data for its own and third-party marketing purposes. You can revoke permission for the use, processing and passing on of the data for marketing purposes at any time by sending PAP a message to this effect. You can do this by post by means of an informal notification sent to Prior Art Publishing GmbH, Manfred-von-Richthofen-Straße 9, 12101 Berlin or by an email to office@remove-this.priorartpublishing.de.

5. Cookies

"Cookies" are small files which enable us to store on your PC or other terminal specific information relating to you, the user, while you are using the PAP services. Cookies help us for example to determine the frequency of use and the number of users of our websites, and to structure our offering so that it is as convenient, efficient and interesting as possible for you.

After you have registered (with user names and password), PAP uses so-called "session cookies" by which you can be identified during your visit. After the end of the session, session cookies automatically expire.

PAP also uses "permanent cookies" in order to retain information about visitors who access the PAP services repeatedly. The purpose of using these permanent cookies is so as continuously to improve our products and services for you. The permanent cookies do not contain any personal data. Name, IP address etc. are not stored. No individual profile relating to your usage behaviour is created.

PAP also uses Google Analytics, a web analysis service from Google Inc. ("Google"). Google Analytics also uses cookies. The information generated by the cookie about your use of the PAP services (including your IP address) is transferred to a Google server in the USA and stored there. Google will use this information to evaluate your use of the website, to collate reports about the website activities for the websites of PAP and to perform further services associated with the use of the website and of the Internet. Google may also transfer this information to third parties where this is prescribed by law or where third parties are processing this data on behalf of Google. Google will under no circumstances combine your IP address with other Google data.

In your browser you can deactivate the storage of cookies, restrict it to certain websites or set your browser so that it informs you as soon as a cookie is sent. You can also delete cookies from the hard drive of your PC at any time. Please note, however, that the PAP services cannot be used if session cookies are refused.

6. Log files

Each time the website is accessed, access data are stored in a protocol file, the server log. The dataset stored contains the following data:

the time, the status, the request which your browser has made to the server, the quantity of data transferred as well as the website from which you have accessed the requested page (referrer), as well as the product and version information of the browser used (user agent). For these purposes PAP uses the standardized "combined" log file format of the Apache web server. However, your IP address is not stored after the visit to the PAP website has ended. Subject to any legal record-keeping requirements, after the use has ended, users' IP addresses are deleted or anonymized. In the event of anonymization, the IP addresses are altered in such a way that the individual details about personal or material circumstances can no longer be attributed to an ascertained or ascertainable natural person, or can only be so attributed with a disproportionately high burden in terms of time, costs and work.

PAP uses the protocol data (logs) in anonymized form, i.e. without attribution or indications of the person to whom they refer, for statistical evaluations. In this way PAP can find out, for example, on which days and at which times the PAP websites' offerings are particularly popular and what volume of data is generated on the PAP websites. In addition, PAP can recognize possible errors by means of the log files, e.g. defective links or program errors, and can thus use the log files for the further development of the PAP websites. PAP does not associate the pages accessed and the usages which are stored in the server log with individual persons. PAP reserves the right to use data from log files if specific facts give rise to a suspicion that users of the PAP websites and/or of the PAP services are using them illegally or contrary to the terms of a contract.

7. Right to information about personal data

You have the right and the opportunity to receive information from PAP at any time about the personal data stored in relation to your person. The request for information must be sent by letter to the address set out in the legal notices section. A certified copy of an official and valid personal identification document must be enclosed with the request for information. The information is sent electronically to the relevant email address.
